Employee Rights When Your Job is Terminated

Employee Rights When Your Job is TerminatedEmployee Rights When Your Job is TerminatedMost private-sector employees in the United States are employed at-will, which means that their employers can terminate their job at any time, for any reason or no reason at all- barring discrimination. This means that many newly terminated employees are taken by surprise. While some employers may provide warnings and advance notice of termination, others move swiftly and unexpectedly. If youve recently lost your job, you may be wondering what your rights are. Because a layoff can happen to anyone, often without warning, it is extremely important to be prepared to change jobs. Periodically update your resume, even if you dont think you will need it soon. Keep your LinkedIn profile up to date, and keep in contact with your network. Have a few potential references in your back pocket, so that you wont have to start from scratch if you lose your job. Preparing yourself for all outcomes will allow for a smooth transition if you need to make any change in employment. Fortunately, terminated employees do have certain rights. In addition to a final paycheck, employees could be entitled to things like continued health insurance coverage, extended benefits, severance pay, and unemployment compensation. It is important to know exactly what your rights are as an employee when you lose your job. Your Rights When Your Employment Is Terminated Jay Warren, counsel in the New York office of Bryan Cave LLP, shares his expertise on employee rights and options for seeking assistance if you have questions about those rights if you believe you have been discriminated against and/or have been subjected to wrongful termination. Sources of Employee Rights Contract Rights Employees who have an individual contract with their employer or employees covered by a union/collective bargaining agreement would be covered under the stipulations in the contract if their employment is terminated. Company Policy When a company plans layoffs, it may have a severance plan in effect. If so, severance pay may be provided if your employment is terminated. Statutory Rights Statutory rights are those provided by federal or state law. They include unemployment insurance, advance notification of the closing of or a substantial layoff at a facility (depending on the size of the company), anti-discrimination laws, and anti-retaliation laws. Getting Information on Your Rights When youre not sure about your rights, the best place to start is with the company Human Resources department. Think Like a Pilot to Learn From Mistakes at Work - The Muse

Think Like a Pilot to Learn From Mistakes at Work - The MuseThink Like a Pilot to Learn From Mistakes at Work When Ofir Paldi entered the prestigious Israeli Air Force Flight Academy at age 18, he received instructions that surprised him. All anyone seemed to want him to talk about were the mistakes he was making. Youre in a very competitive place. You have the biggest motivation to succeed and all you want to do all the time is to be the best and impress everyone around you, he says. And day by day the only thing you are expected to do is to speak about the mistakes you made. After each flight, theyd debrief, covering what they learned, what they couldve done better (and would try to do better next time), and what they did well that they wanted to remember to do again. You can sit down100 pilots together in one room- its the place with the fruchtwein ich in the world- and you can still speak about yur mistakes and you see everybody stand up to share, he says, from the youngest pilot all the way up to the commander. You can sit down100 pilots together in one room- its the place with the most ego in the world- and you can still speak about your mistakes and you see everybody stand up.Ofir PaldiWhen he left the air force after almost nine years as a pilot he became an entrepreneur, and his current business, Shamaym, was inspired by the kind of training he received there. The company, which recently relocated from Tel Aviv to Boston, works with organizations to implement a debriefing-based learning model. To put it simply, they help teams adopt a culture where its not only okay but also imperative to think and talk about mistakes in order to make everyone- and the organization- better. Most people want to learn, in theory, but you always have another meeting and another task and another email, and we just dont find the time to stop and reflect, Paldi says. However, he insists that if pilots in uber high-stress roles can admit to errors to improve their performance, anyone can.You dont have to hire Shamaym to learn how to learn from your mistakes. Heres how you can use this approach to grow in your role and career. Bonus You get to pretend to be a pilot in the process. Photo of Ofir Paldi, former pilot and founder and CEO of Shamaym, courtesy of Ofir Paldi. Step 1 Take Personal Responsibility for Your LearningTheres a lot that changes when you make the transition from student to employee. Perhaps first and foremost, its no longer anyones explicit or sole job to teach you. You may have supportive bosses or kind mentors who show you the ropes and help you grow, but your day-to-day learning is mostly in your own hands. Paldi stresses that one of the main tenets of the approach hes borrowed from the air force is taking personal responsibility. When you finish a task, you are the one whos responsible to learn from it, and you cant wait or think that someone will come and teach you, he says. When you finish a task, you are the one whos responsible to learn from it, and you cant wait or think that someone will come and teach you.Ofir PaldiThats why you can only debrief yourself. When you go over what went well and what didnt, focus on what you did and what mistakes you made, not what your boss, co-workers, clients, or anyone else did. As we spoke on the phone, Paldi used our interview as an example to drive the point home. Lets just say that you didnt get all the information you needed from the call. So you can never speak about me and why didnt you learn from me, he says. You always look at yourself- what I, Stav, could have done better in this call or the preparation for this call in order to get more information. You cant easily change what other people are doing, but you can change what youre doing. Step 2 Figure Out What Your Flights AreIn order to put the debriefing strategy into practice, you have to figure out which recurring and important task you want to focus on. In the air force, its pretty obvious flights. Paldi and the other pilots he trained with would go through their mistakes and successes after each flight. While you probably do your job at a lower altitude, you surely have duties you repeat frequently that are central to your role. Consider those your flights. For example, a reporters flights might be conducting interviews, writing articles, fact-checking, and going through revision processes with their editors, while someone in sales might consider their flights to be making client calls, creating pitch decks, giving presentations, and shepherding deals through contracts to close. Everyones flights will be different. Figure out what yours are and pick one type to start with that you want to work on improving. Step 3 Conduct Short and Simple DebriefsStart debriefing with yourself after each flight. Spend just a few minutes each time asking yourself What went well? What didnt go as well as it could or should have? What can I do better the next time around? Pick out the two or three main th ings that you think you can improve or that you totally nailed and want to repeat. If youre trying to hold yourself accountable, consider keeping a log of your debriefs and referring to it before each flight. And if you work in an environment where youre discussing and setting growth goals with your manager, try incorporating what youre discovering in your debriefs into this formal conversation to help keep yourself on track. The most important thing here is not to wait until something goes horribly wrong to start debriefing. Make it part of your routine even when things are chugging along pretty smoothly. That way, you make learning a habit and youll be able to improve and grow incrementally and consistently. You could potentially even avoid a terrible snafu in the first place, but even if it happens, by the time it does youll be well-versed in the practice of picking apart what went wrong and ensuring you do better the next time. Step 4 Decide What Youll Repeat or Do Differently ( and Be Specific)Paldis biggest tip about those quick debriefing, or learning, sessions is to be extremely specific and extract actionable takeaways. In our human nature, when we learn something we say, Okay, well do better or well do it differently, Paldi says. But its not enough. In our human nature, when we learn something we say, Okay, well do better or well do it differently. But its not enough.Ofir PaldiGoing back to the example of our interview, it wouldnt be enough for me to conclude that I didnt get enough background information. Instead, Id have to come up with the specific questions I should have asked to try to get the material I was missing. You dont have to be a pilot to work like one. Just remember that it can take time to get comfortable being so brutally honest (with yourself or others) about the mistakes youre making. Paldi admits it took a couple of months before he was able to debrief the way his air force instructors wanted him to.Even if at the beginning its a l ittle bit hard, I think that one of the biggest advantages you can take to the business world is your ability to...constantly learn and improve by yourself and maximize your potential, Paldi says. Because its a competitive world out there, its an intense world. No one will be there to do it for you, so your competitive advantage would be if you could do it by yourself.

Top 10 Interview Tips and Tricks

Top 10 Interview Tips and Tricks Top 10 Interview Tips and Tricks Interviews are among the most stressful parts of hunting for a new job. Depending on the job, interviews can take twenty minutes or span several days with multiple interviewers and an intensive screening process.Preparing for an interview is a big part of the job hunting process. Someone can think they have everything covered, only to be thrown a curveball during the interview that leaves them speechless. In this article, we will go over 10 tips to help you get through your next interview.Get the Right ClothesMoney is tight, especially for someone looking for a job, but theres a saying in business that you should dress for the job you want, not the one you have.If youre unemployed, you should consider getting at least one or two sets of clothes that are professional and presentable.Showing up at a job interview in your lucky football jersey isnt going to win you any points with the interviewer, unless they are extraordi narily enthusiasticof the particular team (like, to the extreme).Get clothes that fit properly and dont reveal too much skin. For ladies, a professional skirt is absolutely fine, but keep it at or below knee length. Low-cut tops should be matched with a conservative tank top that covers cleavage.Men should wear a button-up shirt if possible, matched with an undershirt if needed, and tucked in unless its cut specifically not to be tucked.Ties and jackets are optional for many jobs these days, but should be worn if you are interviewing for a job and place where management wears ties.Have Interview Clothes Ready to GoWe all have that one or two really nice sets of clothes that we wear to interviews and important/special events. Unfortunately, these clothes are rarely ready to go at a moments notice. If youre in the process of looking for a new job, you should have a clean, wrinkle-free set of professional attire at the ready should you receive a call for a last-minute interview. This does nt mean you should carry them around with you when you go to the grocery store, but having them ready keeps you from scrambling if you are in a hurry.Practice Answering Common Interview QuestionsThere are some questions that are commonly asked in interviews for just about any lokalitt. They are get to know you questions which, in theory, will help the interviewer get a better understanding of who you are and how you see your role as an employee. These questions by themselves arent terribly difficult for most people to answer, but in the context of the interview, they can be pretty intimidating. Here is a quick list of common questionsWhat are your weaknesses?Name a time when you have been challenged, and explain how you overcame that challenge. What are your career goals? What would your previous coworkers say about their experiences working with you?Why should we hire you?Practice Your Skill, Even if Youre UnemployedIf you are interviewing for a skill-based job such as computer program ming, be prepared to prove your skills in a written or computer-based test. Its very common for some jobs to test candidates either right before or during the interview to make sure they are hiring someone that knows what theyre doing.Common tests given to Web developers is a challenge to create a simple webpage that has a specific feature, or to debug some kinderkarre code.Arrive EarlyArriving late to an interview is one of the worst things you can do. Its better to be 510 minutes early than 510 minutes late. One good strategy would be to leave your home well before your interview and plan out something to do in the area to kill time, such as visit a nearby store or grab a coffee.Research the CompanyTake some time to learn about the company to which you are applying. This means getting a sense for what the company does, and what type of culture it works to cultivate among its employees. You can learn a lot about a company through its website, and find some pretty helpful behind-the-sc enes tips on sites like Glassdoor which hosts reviews of companies left by employees and interviewees.Practice With a FriendPractice interviews are great They help you get over any anxiety you might be having about the process, present you with questions you might not have expected, and give you insight into how well you interview.Find a friend that is honest, and preferably experienced with interviewing people. Tell them to do a practice interview with you (and dont let them go easy on you). Their objective insights will prove invaluable to you when the real interview comes along.Ask Good QuestionsThe questions the interviewer asks are only part of the actual interview. The questions asked by the person being interviewed are often equally important. They give the interviewer an opportunity to get a sense for the interviewees interest in the position, and willingness to ask questions rather than just end things quickly. Here are some good questions to ask the interviewerWhat are the t op priorities of the position? What are some of the challenges that come with the position? What are the qualities that the company looks for in an employee? What is the company culture like?Get a Jump Start on the PositionThis tip might not apply to every type of position out there, but for the ones it does, it is a huge plus for any interviewee.Lets say youre applying for a job as a Web developer. You have some information through questions youve asked leading up to the interview that the position is open because the company needs a new website. If you have the time, consider sketching some rough ideas or creating a mockup of how you would improve on the current website.During the interview, you can explain that you took the initiative of creating this material after seeing what the company is working with right now, and present it.Your ideas might not even be close to what management wants, but the initiative makes a big difference. You wont be the applicant that had schwimmbad ideas (unless they really are bad). You will be the applicant that cared enough to do something.Confidence is KeyConfidence in your qualifications and ability to do the job is what most interviers are looking for. They want to know that youre able to hit the ground running with the position, and an applicant that is too timid or unsure of themselves does not instill the same confidence.Practice interviewing into a mirror, or put your practice interviews on video and watch them. Think about things you can do to seem more confident in your answers, and practice them.Part of having confidence is being comfortable in the position youre in. The more you practice, the more comfortable you will be.There is a fine line between confidence and bravado, though. Make sure you are staying on the right side of that line, and your interviewer will notice and appreciate it. If youre looking for more tips, check out this checklist from GoodCall, it details steps to take before, during and after an import ant interview.

Speak the language of your audience or dont speak at all

Speak the language of your audience or dont speak at allSpeak the language of your audience or dont speak at allLets get down in the weeds for a second about social-media marketing.I cannot tell you how many times a day I hear the words, We need to be on Facebook. We should be posting more on Twitter. We should show people our culture on Instagram.Nobody cares.Thats the cold, honest, brutal truth.Nobody cares about your culture?- ?unless you have the best, most unique, knowledgeable, entertaining, orsomethingculture.Nobody cares about the 5 Ways to Create an Effective Marketing Strategy blog that you posted, for the first time in six months?- ?unless those 5 Ways are in some way different and very unique compared to everyone elses 5 Ways.Nobody cares where you and your team went to eat for lunch?- ?unless where you went to eat welches somewhere super cool, and everyone on your team created food art, and each food art recipe can be found on your website, along with a step-by-step guid e on how to create said incredible food art at home.Unless you are doing something different, or informative, or valuable to the audience you are looking to reach, nobody cares. Except your mom. She will probably hit Like.It is astounding to me how many people think the simple act ofhavinga Facebook page or a Twitter handle is, in any way, effective. Thats like thinking your purchasing a personenname tag at a networking event is going to bring you leads. What are people going to do? Walk up to you, you there sitting in the chair in the back room not talking to anyone, and say,Oh I see your name is John Can I purchase whatever it is youre selling, John? Please tell me you realize how ridiculous that sounds. And yet this is the mentality the majority of people, brands, businesses, and so-called thought leaders have when it comes to using social media. If your strategy is to post seven times a week, youre doing it wrong. If your strategy is to use photos instead of text, youre doing it wron g.If your strategy is to be on social media, youre doing it wrong. That is not a strategy. This is a particularly smart thing to do if the summer job is in any way related to yourfuture career goals. For example, a camp counselor who wants to be a teacher should definitely ask the camp for a referral, since the su mmer experience involved working with children. Be sure to include your contact information (schmelzglas and phone number) so that your summer employer knows where to reach you if future job openings arise, or if they receive requests for referrals from hiring committeesthat you may apply to after graduation.
